1. About these terms
These terms of service apply to all quotations, works and services provided by Timberpro Carpenters Pty Ltd (ABN 83 702 121 444) (“we”, “us”, “our”) to our clients (“you”) throughout Perth, Western Australia. By accepting a quotation, engaging our services, or allowing work to commence at your property or site, you agree to be bound by these terms. Where a signed contract is entered into for a specific project, the terms of that contract will apply alongside, and prevail over, these terms to the extent of any inconsistency.
2. Quotations and estimates
- Quotations are valid for 30 days from the date of issue unless otherwise stated in writing.
- Quotations are based on the information, plans and site conditions known to us at the time of preparation. If actual site conditions differ, or if requested changes are made, the quoted price may need to be adjusted.
- Where we provide an estimate rather than a fixed quotation (for example, an indicative hourly rate or a provisional sum for materials), the final price may vary. We will inform you as soon as practicable if the final price is expected to exceed an estimate.
- Quotations assume safe and reasonable access to the worksite during normal business hours.
3. Acceptance and commencement of works
An engagement is formed when you accept our quotation in writing (email acceptance is sufficient) or otherwise instruct us to proceed. Once works are scheduled, commencement dates are indicative and subject to availability of our team, materials and suitable weather conditions. We will keep you informed of the expected start and completion dates for your project.
4. Variations
No variation to the agreed scope of works will be carried out without your prior written approval (email is acceptable). Variations may affect the price and the completion date. If we identify work that we consider necessary or prudent beyond the quoted scope — for example, repairs to framing discovered after opening up a wall — we will pause the affected portion of the works where practicable and provide a variation quotation for your approval before proceeding.
5. Payment terms
- Where a deposit is required, it will not exceed the maximum percentage permitted for home building work under the Home Building Contracts Act 1989 (WA).
- Progress payments are payable at the stages set out in your quotation or contract.
- Invoices are payable within seven (7) days of the date of issue unless your quotation states otherwise.
- If an invoice remains overdue, we may, after giving you written notice, suspend works (including works in progress) until the outstanding amount is paid, and may charge reasonable administration costs and interest on the outstanding amount.
- You are responsible for any bank fees associated with payments made from outside Australia.
6. Access, site conditions and delays
You are responsible for providing safe, lawful and reasonable access to the worksite, including access to power and water where required for the works. You must inform us of any known hazards at the property before works commence.
Where works are delayed by matters beyond our reasonable control — including adverse weather, supplier or delivery delays, or the discovery of latent conditions such as hidden water damage, termite damage, non-compliant existing structures or materials containing asbestos — we will notify you promptly and the completion date will be extended accordingly. Where latent conditions require additional work, we will provide a variation quotation before proceeding, except where an urgent safety concern requires immediate action, in which case we will act as reasonably necessary to make the site safe and inform you as soon as practicable.
7. Materials and workmanship
We warrant that our services will be carried out with due care and skill, and that materials supplied by us will be of acceptable quality and fit for their intended purpose, consistent with the quotation. We will rectify, at no cost to you, defects in our workmanship that are notified to us in writing within twelve (12) months of practical completion. Warranties provided by manufacturers or suppliers of materials (including timber products, fixings and finishes) are passed on to you to the extent permitted, and claims under those warranties may need to be made directly with the manufacturer or supplier. This warranty operates in addition to, and does not limit, your rights under the Australian Consumer Law.
8. Australian Consumer Law guarantees
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law, including the Fair Trading Act 2010 (WA).
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with our services, you are entitled to cancel your contract with us and obtain a refund of the price paid, or compensation for the reduction in value of the services. For minor failures, we may choose to remedy the failure within a reasonable time or to pay you compensation for the reduction in value of the services. You are also entitled to be compensated for any other reasonably foreseeable loss or damage caused by our failure to meet a consumer guarantee.
For domestic building work in Western Australia, the statutory warranties and other protections set out in the Home Building Contracts Act 1989 (WA) also apply where relevant.
9. Liability and insurance
To the maximum extent permitted by law, and except where such limitation is not permitted by the Australian Consumer Law or other applicable legislation, our liability for any claim arising out of or in connection with our services is limited, at our option, to supplying the services again or paying the cost of having the services supplied again. We are not liable for indirect or consequential loss to the extent the law permits such exclusion.

10. Suspension and cancellation
You may cancel an engagement at any time by giving us written notice. If you cancel after a quotation has been accepted or after works have commenced, you will be responsible for the reasonable costs of labour performed, materials specially ordered for your project, and any non-refundable supplier or delivery costs incurred up to the date of cancellation.
We may suspend or terminate an engagement, after giving you written notice, if payment remains overdue, if safe access to the site is not provided, or if we are directed to perform work that is unlawful or unsafe.
11. Intellectual property
Any sketches, drawings, plans, schedules or design concepts prepared by us for your project remain our intellectual property unless expressly assigned in writing. Upon full payment for those design services, you are granted a licence to use them for the purpose of your project. Quotations and other commercial documents we provide remain our confidential information.
12. Privacy
We handle personal information in accordance with our Privacy Policy. By engaging our services, you consent to us collecting and using the information you provide for the purposes of quoting, performing and administering the works, and contacting you about your project.
13. Dispute resolution
If you have a concern about our services, please contact us first so we can work towards a fair and prompt resolution. Where a dispute cannot be resolved by direct discussion, the parties agree to attempt resolution through good-faith negotiation, and if necessary mediation in Perth, Western Australia, before commencing court proceedings. Nothing in this clause prevents either party from seeking urgent injunctive relief, or from making a complaint to Consumer Protection at the Department of Energy, Mines, Industry Regulation and Safety in Western Australia or another applicable regulator.
14. Governing law
These terms and any engagement with us are governed by the laws of Western Australia and the Commonwealth of Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
15. Changes to these terms
We may update these terms from time to time. The version published on this page at the date a quotation is issued will apply to that engagement unless otherwise agreed in writing. Material changes will be reflected in the “last updated” date shown at the top of this page.
